By using Barger Mechanical's website, services, or engaging with us in any way, you agree to be bound by these Terms and Conditions. If you do not agree with these terms, please do not use our services or website.
2. Services Provided
Barger Mechanical provides HVAC (Heating, Ventilation, and Air Conditioning) services, including but not limited to:

Routine maintenance agreements
3. Service Appointments and Scheduling
3.1 Appointment Scheduling

Services are provided by appointment or emergency call basis

We will confirm appointment times and provide estimated arrival windows

Weather conditions, traffic, or emergency calls may affect scheduled appointment times

We will make reasonable efforts to maintain scheduled timeframes
3.2 Cancellation Policy

Customers may cancel appointments with at least 24 hours advance notice without penalty

Same-day cancellations or no-shows may be subject to service fees

Emergency service calls have different cancellation terms and fees may apply

3.3 Access Requirements

Customer must provide clear access to HVAC equipment and work areas

Customer is responsible for ensuring pets are secured or removed during service

Barger Mechanical reserves the right to refuse work if safe access cannot be provided
4. Payment Terms and Conditions
4.1 Pricing and Estimates

Service calls include an initial diagnostic fee

Written estimates will be provided for work exceeding the diagnostic fee

Estimates are valid for 30 days from the date issued

Emergency service calls may carry additional fees
4.2 Payment Methods

Payment is due upon completion of service unless other arrangements are agreed upon in writing

We accept cash, check, credit cards, and electronic payment

A processing fee may apply to certain payment methods
4.3 Maintenance Agreements

Annual maintenance agreements are available for residential and commercial customers

Agreements automatically renew annually unless written cancellation notice is provided at least 30 days before renewal

An annual increase of up to 8% may apply upon renewal

5. Customer Responsibilities
5.1 Maintenance

Customer is responsible for regular filter changes and basic maintenance as recommended

Failure to maintain systems may void equipment warranties

Customer should schedule regular professional maintenance as recommended by manufacturers

Barger Mechanical is not responsible for system failures resulting from lack of maintenance
5.2 Safety and Disclosure

Customer must inform Barger Mechanical of any hazardous conditions at the property

Customer is responsible for ensuring safe working conditions
-
Any safety concerns discovered during service may result in work stoppage until resolved

Customer must disclose any known defects or issues with systems prior to service
5.3 Property Protection

Customer should remove or protect valuable items in work areas

Barger Mechanical will take reasonable care to protect property during service

Customer is responsible for providing accurate information about their property and systems
-
Customer assumes responsibility for damage to property caused by natural hazards or conditions not disclosed
6. Barger Mechanical's Responsibilities and Limitations
6.1 Professional Standards

Barger Mechanical maintains all required licenses and certifications

All work complies with local building codes and regulations
-
Work is performed by trained and certified technicians
-
We stand behind our workmanship with appropriate warranties
6.2 Liability Limitations

Barger Mechanical is not liable for indirect, incidental, or consequential damages

Our liability is limited to the amount paid for the service in question
-
We are not responsible for damage to property caused by customer's failure to disclose hazards
-
Emergency service availability is not guaranteed; response times vary based on call volume
6.3 Warranty Disclaimer

Equipment warranties are provided by manufacturers and are subject to their terms
-
Labor warranties are limited to 12 months from the date of service for work performed by Barger Mechanical
-
Warranties do not cover damage from improper maintenance, misuse, or failure to follow manufacturer guidelines

Extended warranties may be available for an additional fee
7. Compliance and Permits

Barger Mechanical maintains all required licenses and certifications

Permit requirements and associated costs are the responsibility of the customer unless specified in a separate agreement

Barger Mechanical reserves the right to refuse work that does not meet applicable code requirements

Customer is responsible for obtaining necessary homeowner association approvals or permits
8. Force Majeure
We are not liable for delays or failures in performance due to circumstances beyond our control, including but not limited to:

Natural disasters, severe weather, or environmental events

Government actions or regulatory restrictions

Labor disputes or workforce unavailability

Supply chain disruptions or material shortages

Public health emergencies or pandemics

Other unforeseeable events
9. Dispute Resolution and Governing Law
9.1 Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Arkansas, without regard to its conflict of law provisions.
9.2 Jurisdiction
Any legal action or proceeding arising out of these terms shall be brought exclusively in the courts located in Saline County, Arkansas, and you consent to the exclusive jurisdiction and venue of such courts.
9.3 Dispute Resolution

10. Changes to Terms
